Agreement to Terms
By downloading, installing, or using any of our applications — including Podify.Chat, imem, WarpOne, and related apps (collectively, the "Services") — you agree to be bound by these Terms of Use. If you do not agree, do not use the Services. The Services are operated by Alexander Hooper ("we", "our", or "us").
Subscriptions and In-App Purchases
Subscription Plans
Some features of the Services are available only through a paid subscription. Subscription pricing and included features are displayed at the time of purchase within the app or on our website.
Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings.
Free Trials
Where a free trial is offered, you will not be charged until the trial period ends. If you cancel before the trial ends, you will not be charged.
Cancellation
You may cancel your subscription at any time through your Apple ID account settings (Settings → Apple ID → Subscriptions). Cancellation takes effect at the end of the current billing period — you retain access until that date. We do not offer refunds for partial subscription periods except where required by law.
Price Changes
We reserve the right to modify subscription pricing with reasonable notice. Continued use of the Services after a price change takes effect constitutes your acceptance of the new price.
Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms
- Attempt to reverse engineer, decompile, or disassemble any part of the Services
- Use automated means (bots, scrapers) to access or collect data from the Services
- Interfere with or disrupt the integrity or performance of the Services
- Attempt to gain unauthorized access to any part of the Services or related systems
- Use the Services to harass, abuse, or harm others
- Redistribute, sublicense, or resell access to the Services
AI-Generated Content
Our Services use artificial intelligence to generate responses and content. AI-generated content:
- May contain errors, inaccuracies, or outdated information
- Does not constitute professional advice (legal, medical, financial, or otherwise)
- Should not be relied upon as a sole source of information for important decisions
- Does not represent the official views of any third party referenced
Intellectual Property
The Services and their original content, features, and functionality are owned by Alexander Hooper and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
Podcast content surfaced through the Services remains the property of the respective podcast creators and is used in accordance with applicable fair use and indexing principles.
Third-Party Services
The Services integrate with third-party platforms including Apple (for payments and authentication), OpenAI, and others. Use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ALEXANDER HOOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
Termination
We reserve the right to suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Services ceases immediately.
Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in California.
Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
